Kentucky Car Insurance Laws
According to the Kentucky Transportation Cabinet, Kentucky’s car insurance laws require all drivers to present proof of liability insurance when they register their vehicle. Kentucky vehicle owners with cars registered in their name must be able to certify that they have insurance and that it meets Commonwealth minimum requirements for:
- $25,000 for bodily injury to or death of one person in any one accident;
- $50,000 for bodily injury to or death of two or more persons in any one accident, subject to a $25,000 per person limit; and
- $25,000 for injury to or destruction of property in an accident.
Kentucky Penalties for Driving Without Car Insurance
In the Commonwealth of Kentucky, it is illegal to drive any motor vehicle without proof of insurance or financial responsibility. The driver must maintain proof of continuous insurance throughout the registration period. If your personal vehicle is identified as uninsured, the vehicle’s registration will automatically be canceled thirty days after you receive an Uninsured Notice from the Kentucky Transportation Cabinet’s Department of Motor Vehicle Regulation. Registration will not be restored until proof of insurance is provided to your County Clerk.
Kentucky DUI/DWI Laws and Penalties
Kentucky DUI laws state that drivers with a Blood Alcohol Concentration (BAC) of 0.08 or more are considered to be driving under the influence.
First Offense Within a Five Year Period
• $200 – 500 Fine
• 2 to 30 Days in Jail*
• 90 Days of Alcohol or Substance Abuse Program
• 30 to 120 Day License Suspension
• Possible 48 Hours – 30 Days Community Labor
Second Offense Within a Five Year Period
• $350-500 Fine
• 7 Days – 6 Months in Jail*
• 1 Year of Alcohol or Substance Abuse Treatment
• 12 to 18 Month License Suspension
• 10 Days-6 Months Community Labor
Third Offense Within a Five Year Period
• $500 – 1,000 Fine
• 30 Days-12 Months Jail*
• 1 Year of Alcohol or Substance Abuse Treatment
• 24 to 36 Month License Suspension
• 10 Days-12 Months Community Labor

Kentucky Cell Phone Driving Laws and Texting While Driving Laws
The Commonwealth of Kentucky currently does not have a full ban on cell phone use for all drivers. However, novice drivers under the age of 18 are prohibited from using a cell phone in any manner (talking, texting, playing games, etc.) while driving. Kentucky also has a texting while driving ban for all drivers. Violators could face a fine up to $50.
Kentucky SR-22 Insurance Documents
Kentucky does not require an SR-22 for DUI offenses. However if you have an SR-22 filing in another state, and move to Kentucky you must maintain your SR22 in the state where it is required. An SR-22 form may need to be filed for three years with your former state, showing proof of financial responsibility. This filing is usually required after the suspension of your driving privileges has been lifted. Your insurer can electronically file SR-22 insurance documents with your former state for drivers that are required to keep and show valid auto liability insurance.
